À l’heure où les machines intelligentes envahissent la scène médiatique, où les transhumanistes tentent de s’affranchir des limites de l’homme, où la circulation des données personnelles sème le trouble sur l’identité humaine, où les animaux gagnent en considération et où l’on s’inquiète, en tout lieu, pour l’avenir de la planète, une question cruciale se pose en droit : la vieille distinction des personnes et des choses est-elle encore satisfaisante pour faire face aux grands défis du XXIe siècle ? C’est à cette problématique que cette recherche entend répondre. En faisant une large place aux dialogues des discours, cette thèse présente et analyse les désordres auxquels la distinction et ses notions, dont ce travail reprend la genèse, se heurtent. Elle interroge donc les frontières et encourage, plus largement, une réflexion collective sur le rapport du droit aux progrès scientifiques ainsi que sur l’importance des valeurs. Armée de la sorte, elle propose d’instituer l’humain afin de promouvoir un nouveau visage de l’humanisme qui permette non seulement de contrer la réification de l’homme, mais également de répondre au mouvement d’anthropomorphisation des choses.

In the day and age when intelligent machines are taking over the media scene, when transhumanists are trying to break free of human limitations, when the circulation of personal data is casting doubt on human identity, when animals are gaining in consideration and when people everywhere are worried about the future of the planet, a crucial question is arising in the legal realm: is the old distinction between persons and things still relevant when it comes to dealing with the major challenges of the 21st century? This is the question that this research strives to answer. With a focus on dialogues between discourses, this thesis looks into the disorders that the distinction and its notions - the genesis of which is reviewed in this work - come up against. It thereby questions boundaries and, more broadly, prompts a collective reflection on the relationship between law and scientific progress, as well as on the importance of values. These insights will be used to institute the human in order to promote a new face of humanism that not only counters the commodification of mankind, but also responds to the movement towards the anthropomorphisation of things.
